TERMS & CONDITIONS, RENTAL AGREEMENT & PRIVACY POLICY

1. ACCEPTANCE OF TERMS

These Terms & Conditions govern the use of the Artemuse threads. website and all rental services provided by Artemuse threads.

By placing a booking, attending a studio appointment, or using this website, you acknowledge that you have read, understood and agreed to be legally bound by these terms.

If you do not agree, you must not use our services.

SECTION A – RENTAL AGREEMENT

2. RENTAL PERIOD

The hire period commences on the start date selected at checkout and concludes on the final booked date.

Delivery and return days are included within this period.

For example:
A booking from Friday to Monday includes Friday as delivery day and Monday as return day.

We strongly recommend commencing your hire 1–2 days prior to your event to allow for possible courier delays.

Artemuse threads. is not responsible for late deliveries caused by third-party shipping providers.

3. SHIPPING & DELIVERY

All postal rentals are dispatched via express shipping.

Tracking information will be provided. Once tracking has been issued, responsibility for monitoring shipment transfers to the renter.

Delivery is not guaranteed before 6:00 PM on the selected delivery date in accordance with Australia Post guidelines.

We are not liable for delays, redirections, failed deliveries due to incorrect addresses, or courier disruptions beyond our control.

4. RETURN REQUIREMENTS

All items must be returned on or before the agreed return date.

Failure to return by the due date will result in late fees.

Items must be returned in the same condition as received, allowing for reasonable wear consistent with rental use.

5. LATE FEES

A late return fee of $30 per day applies for each calendar day overdue.

If a garment remains unreturned for more than 15 days after the due date, it will be considered permanently unreturned.

In such cases, Artemuse threads. may charge:

• 150% of the garment’s retail value
• Any accumulated late fees
• Administrative recovery costs

6. OWNERSHIP & TRANSFER OF RISK

All garments remain the sole property of Artemuse threads at all times.

Risk transfers to the renter upon delivery or collection.

The renter accepts full responsibility for:

• Safekeeping
• Protection from theft
• Third-party handling
• Accidental damage

7. DAMAGE POLICY

Minor repairable damage or staining is covered up to $100.

If repair costs exceed $100, the renter must pay the difference.

Damage assessments are determined solely by Artemuse threads.

Damage includes (but is not limited to):

• Rips or tears
• Burn marks
• Permanent staining
• Fabric alteration
• Structural damage

8. CLEANING POLICY

Professional cleaning is included in the rental fee.

Under no circumstances should customers:

• Wash
• Dry clean
• Steam
• Alter
• Attempt repairs

Unauthorised cleaning or alterations that cause damage may result in full replacement charges.

9. LOSS, THEFT OR IRREPARABLE DAMAGE

If a garment is lost, stolen, or deemed beyond repair, the renter is liable for replacement.

Replacement value may consider:

• Current retail cost
• Market demand
• Brand availability
• Cancelled future bookings

10. CANCELLATIONS & STORE CREDIT

We do not provide monetary refunds for change of mind cancellations.

If cancellation occurs:

• 30 days or more prior → Store credit minus $30 administration fee
• Less than 30 days prior → No credit issued

Store credit:

• Valid for 24 months
• Non-transferable
• Single-use
• Final once redeemed

Price adjustments apply to exchanges.

11. SIZE ISSUES

If an item does not fit:

• You must notify us within 6 hours of delivery
• Clear photographs must be provided
• Item must be returned same day via express shipping

If approved, a single-use store credit (minus $30 fee and shipping) will be issued.

Sizing claims are not valid where a studio trial has occurred.

12. GARMENT CONDITION DISCLAIMER

Rental garments may show minor signs of wear from previous bookings.

Examples include:

• Fabric pilling
• Minor interior marks
• General wear

Such conditions do not constitute faults.

13. IDENTIFICATION

We may request government-issued photo identification prior to confirming a booking.

Failure to provide identification may result in booking cancellation.

14. FORCE MAJEURE

Artemuse threads. shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to natural disasters, government restrictions, pandemics, transport disruptions, or strikes.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Artemuse threads. liability is limited to the rental amount paid.

We are not liable for:

• Event cancellations
• Courier delays
• Indirect financial loss
• Emotional distress
• Consequential damages

16. CHARGEBACK & PAYMENT DISPUTES

Initiating a payment dispute or chargeback without contacting us first constitutes breach of these Terms.

We reserve the right to recover administrative, legal and recovery costs associated with false or fraudulent disputes.

SECTION B – STUDIO TRIAL POLICY

17. STUDIO LOCATION

Private fittings are available at:

584 Brunswick St, New Farm QLD 4005
Queensland, Australia

Appointments are strictly by booking only.

18. $20 TRIAL FEE

A $20 studio trial fee applies per appointment.

This fee:

• Secures your time slot
• Covers consultation and fitting time

The fee is non-refundable for missed appointments.

Rescheduling may be permitted with 24 hours notice.

19. STUDIO CONDUCT

Clients must handle garments carefully.

Excessive makeup, tanning products or strong fragrances should be avoided.

Damage during trial may incur repair charges.

SECTION C – WEBSITE TERMS OF SERVICE

20. WEBSITE USE

This website is operated by Artemuse threads.

By accessing or purchasing through this website, you agree to comply with these Terms.

Our store is hosted on Shopify Inc.

21. ELIGIBILITY

You confirm that you:

• Are of legal age in your jurisdiction
• Will not use services for unlawful purposes
• Will not infringe intellectual property

Violation may result in termination.

22. ACCURACY OF INFORMATION

We aim to ensure information is accurate but do not guarantee completeness or timeliness.

Prices and availability may change without notice.

23. THIRD-PARTY SERVICES

We may use third-party providers including payment processors and analytics services.

We are not responsible for third-party policies or conduct.

24. USER SUBMISSIONS

Any feedback, ideas or suggestions submitted to Artemuse threads. may be used without compensation or obligation.

25. PROHIBITED USES

Users must not:

• Violate laws
• Transmit malicious code
• Harass or defame others
• Interfere with website security

26. INDEMNIFICATION

You agree to indemnify and hold Artemuse threads. harmless against claims arising from breach of these Terms.

27. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia.

Any disputes shall be resolved within Queensland jurisdiction.

SECTION D – REFUND POLICY

Refunds are provided only where required under Australian Consumer Law.

All other cancellations are subject to store credit conditions outlined above.

SECTION E – PRIVACY POLICY

29. USE OF INFORMATION
